Deferred Areas

The Deferred Areas relate to 15 areas within Ku-ring-gai that have been deferred from inclusion in the Ku-ring-gai Local Environmental Plan 2015 (KLEP 2015) to allow for reassessment of bushfire evacuation risk and proposed zoning changes. The recommendations for deferral were approved during an Ordinary Council Meeting on 26 November 2013.
The Ku-ring-gai Planning Scheme Ordinance applies to all development within a Deferred Area, with the zoning under the exhibited version of the Deferred Areas Planning Proposal as a matter for consideration. View Public Exhibition of Deferred Areas Planning Proposal.

Several development control plans (DCP) compliment the Ku-ring-gai Planning Scheme Ordinance.

Bushfire evacuation risk areas

13 areas have been identified as high bushfire evacuation risk areas which have been deferred to allow reassessment of excavation risk and proposed zoning changes.

The areas are identified on the following maps:

Land identified in the vicinity of ‘The Briars’, Wahroonga

An area of land has been identified in the vicinity of ‘The Briars’ 14 Woonona Avenue, Wahroonga. This land includes 16 & 18 Woonona Avenue (also known as 2-14 Everett Way) and 3-13, 15, 17, 19 Bundarra Avenue South, Wahroonga.

This area was deferred to allow reassessment of the R4 High Density Zone and Development Standards in this location. The area is identified on the following map:

Land at Killara Golf Club

An area of land at Killara Golf Club. The land comprises Lot 2 DP535219 and is located at the eastern portion of the Golf Club. The area was deferred to allow reassessment of the RE2 Private Recreation zoning on this parcel of land, which was previously zoned part Residential 2(b) under the Ku-ring-gai Planning Scheme Ordinance. The area is identified on the following map:

Steps to include the Deferred Areas in KLEP 2015

Council has prepared a Planning Proposal to amend the Ku-ring-gai Local Environmental Plan 2015 to include the 13 bushfire evacuation risk deferred areas. 

What is a Planning Proposal?

The Department of Planning and Environment issued a Gateway Determination on 27 June 2016.  Further consultation was undertaken with the NSW Rural Fire Service and Police prior to the Planning Proposal being placed on public exhibition.

Public exhibition of the Planning Proposal commenced on Thursday 17 November 2016 and will end on Friday 16 December 2016.

At the Council meeting of 2 May 2017 Council considered a report on the submissions received from the public exhibition. Council resolved to adopt the Planning Proposal.
