In 2007 Ku-ring-gai Council acquired 9, 15, 17 Dumaresq Street under its longstanding policy of purchasing suitable land for public open space such as parks and playgrounds.

In 2013 Council prepared a Development Control Plan (DCP) which included objectives and controls for the Gordon Local Centre. The DCP adopts a place-based planning approach aimed at high quality buildings, landscaping and community spaces. Section B - Part 14D provides detailed guidance for the location, design and assessment of new development within the Gordon Local Centre, including the provision of a new public park on the current Council car park site in Dumaresq Street, linking to McIntyre Street.

Council’s intention is to fund new public facilities for the Gordon centre as a whole, under its program of urban renewal called Activate Ku-ring-gai. Under Activate Ku-ring-gai Gordon, along with Turramurra and Lindfield, is identified as a major local centre that will be significantly upgraded.

Under the Ku-ring-gai Local Environmental Plan (Local Centres) 2012, the Gordon Local Centre is zoned B2 Local Centres. This is to provide a variety of compatible uses including public open space.
The current Planning Proposal retains the current zoning, standards and permitted land uses on the three sites. It seeks to reclassify 9, 15, 17 Dumaresq Street from Community Land to Operational Land. An Operational Land reclassification will provide flexibility for a future Gordon Civic Hub Masterplan. The intention of the Masterplan is to promote high quality built form and well-designed public spaces and community facilities within the Gordon Local Centre.
About the Planning Proposal
This site is part of the Gordon Hub Precinct. Council is in the process of preparing an urban design study and masterplan to guide the future redevelopment of the whole Gordon Hub to consider a range of improved civic, cultural and community facilities, including a public park and opportunities for new specialty retail, cafes and restaurants located away from Pacific Highway. The objective of this Planning Proposal is to reclassify Council owned land so-as to provide flexibility in the design and implementation of the future Gordon Hub masterplan.
The proposed amendment to the planning provisions applying to the site would enable the redevelopment in accordance with the masterplan for the Gordon Hub (currently being prepared by Council), thereby allowing Council to consider using its landholdings to assist in facilitating the redevelopment of the Gordon Centre.

The reclassification of 9, 15, 17 Dumaresq Street, Gordon does not alter the current zoning or standards of those sites.
It is important to note that Council:
- Has no power to sell, exchange or otherwise dispose of community land
- May grant a lease or license of community land, but only in accordance with the Local Government Act
- May grant any other estate in community land to the extent permitted by the Local Government Act or under the provisions of another Act
- May sell, exchange or otherwise dispose of operational land.
Upon reclassification to operational land, the site will be available for divestment (if required); this would be conducted in accordance with the procedures outlined in Council’s Acquisition and Divestment of Land Policy (September 2009) and with relevant provisions of the Local Government Act 1993. The future divestment of the site would be the subject of a separate report to Council following the proposed reclassification.

Council sought comment from the community on a Planning Proposal to amend the Ku-ring-gai Local Environmental Plan (Local Centres) 2012 to reclassify Council land at 9, 15, 17 Dumaresq Street, Gordon from Community Land to Operational Land.
A Public Hearing was held at Council on Thursday 22 March 2018 in accordance with Section 57(6) of the Environmental Planning & Assessment Act. An Independent Chairperson, Mr Lawrence Winnacott, was appointed to conduct the Public Hearing.
