Section 94 Development Contribution Plans
In accordance with Clauses 11 and 12 of Ku-ring-gai Council's Section 94 Contributions Plan 2004-2009 Residential Development (Amendment 2) which came into force on 30 July 2008, the contribution rates have been adjusted to reflect the
December 2008 quarter of the Consumer Price Index and Housing Price Index (21KB).
These figures were released by the Australian Bureau of Statistics on 28 January 2009 and 2 February 2009 respectively and are publicly available on the ABS website.
Section 94 Contributions Plan 2004-2009 - Residential Development - Amendment No. 2
This Plan first commenced operation on 30 June 2004. It was amended in 2007 and Amendment 1 commenced operation on 19 October 2007. A second minor amendment to bring occupancy rates into line with the Town Centres Development Contributions Plan to allow differential rates for dwelling houses, medium and high density dwellings was co-exhibited with the Town Centres Development Contributions Plan and came into operation on 30 July 2008. The per person contribution rates did not change from Amendment 1. Amendment 2 applies to applications for residential development lodged on or after that date.
This contributions plan enables Ku-ring-gai Council to levy development contributions where anticipated new development and growth of the resident population will increase the demand for these services and facilities over and above those already available in the Local Government Area.
Facilities for which contributions are collected for include:
- Community facilities.
- Recreation facilities and open space.
- Traffic, pedestrian and cycleway facilities and public domain improvements.
- Plan Administration.

What types of residential development are subject to this contributions plan?
This Section 94 Plan applies to all forms of new residential development. This means it applies to all new free standing houses, villa homes, townhouses, dual occupancies, land subdivisions for residential purposes, flats / apartment buildings and any other form of residential development. It also includes new housing built under State Environmental Planning Policy (Seniors Living) 2004 (SEPP (Seniors Living)). Previously, a separate plan applied to State Environmental Planning Policy No 5 development (as SEPP (Seniors Living) was previously known).
Why has Ku-ring-gai Council prepared this Section 94 Contributions Plan?
In the past several years Ku-ring-gai's population has been growing as has the number of dwellings in the area. The growth in population has led to increased demand for existing facilities and services. This demand will increase under the more significant population growth associated with the implementation of Stage 1 of the Residential Development Strategy. Local Environmental Plan (LEP) 194 implements Stage 1 of this strategy.
Ku-ring-gai Town Centres Development Contributions Plan 2008
This Plan commenced operation on 30 July 2008 and applies to applications for development in the six Town Centres (see maps in the Contributions Plan) lodged on or after that date.
This Contributions Plan enables Ku-ring-gai Council to levy development contributions where anticipated new development and population growth will increase the demand for these services and facilities over and above those already available in the Local Government Area. It applies in addition to Section 94 Contributions Plan 2004-2009 - Residential Development - Amendment No.2.
Facilities for which contributions are collected for include:
- Additional traffic, pedestrian and cycleway facilities and public domain (streetscape) improvements arising from development in the Town Centres.
- Additional community facilities.

What types of development are subject to this Contributions Plan?
This Development Contributions Plan applies to all new development in the Town Centres that increases the demand for the facilities that the plan provides for. This means it applies to all new free standing houses, villa homes, townhouses, dual occupancies, flats / apartment buildings and any other form of residential development including new housing built under State Environmental Planning Policy (Seniors Living) 2004 as well as retail and commercial development.
Why has Ku-ring-gai Council prepared this Development Contributions Plan?
In the past several years Ku-ring-gai's population has been growing as has the number of dwellings in the area. The growth in population has led to increased demand for existing facilities and services. Additionally the Department of Planning's North Sub-Regional Strategy requires Ku-ring-gai Council to increase this potential and plan for a total of 10,000 additional dwellings, being an additional residential population of approximately 17,000 plus the additional retail and commercial development required to support that population. This development will be concentrated in and around the six Town Centres of Turramurra, Pymble, St Ives, Gordon, Lindfield and Roseville with all the inherent additional demands generated by intensive redevelopment. This Contributions Plan was drafted to provide for that additional demand to ensure that the Town Centres provide a vibrant, active village area to support that intensity of development.
Which Other Development Contribution Plans apply in Ku-ring-gai ?
- 1993 Section 94 Plan (applies to all new applications for commercial development outside the six Town Centres)
- Car Parking and Traffic Management Contributions for Specific Commercial centres or development precincts being Wahroonga, West Lindfield, commercial centres and 9-15 Curagul Road North Turramurra. These contributions only apply when insufficient car parking can be provided on site or where traffic management measure or road works are required as a result of new development.
